Can you give me legal advice?

What type of Identification do I need to have?

Acceptable Identification Documents MUST be Physically in your possession:

* Valid (NON Expired) Drivers License or Identification card issued by a U.S. state

*A passport issued by a foreign government, stamped by the U.S. Citizenship and Immigrations Services (USCIS)

*An identification card issued by any branch of the Armed Forces of the United States.

*Names Must matched the names(s) on the document being notarized.

Any identification above is acceptable as long as it

1) is current or issued within the past 5 years

2) contains a photo and physical description of the person named

3) bears a signature of the person

4) bears a serial or other identifying number

5) in the event that it is a foreign passport, is stamped by the USCIS (TCA 66-22-106[c])

What if I am unable to sign due to physical disability?

Mark Serves as Signature - A person who cannot sign his/her name because of illiteracy or physical disability may instead use a mark --an "X" for example -- as a signature.

Witnesses for a signature by Mark to be notarized, the National Notary Association recommends that there be two (2) witnesses to the making of the mark in addition to the Notary

If you do not have a two (2) witness, we can provide one or both for an additional fee.

Can I have a copy notarized?

AA notary public in Tennessee is NOT authorized to certify copies and it is actually ILLEGAL for a notary to certify a copy of a vital document (such as a birth certificate).

Notaries in Tennessee can notarize what is called “Copy Certification by Document Custodian”photocopy r Fax may be notarized as long as the signature on it is Original, meaning that the photocopy or Fax must have been signed with pen and ink. Signatures on documents presented for notarization must always be signed with a handwritten, original signature.

Be aware; Public recorders sometimes will not accept notarized photocopies or faxes, because the text of the document may be too faint to adequateeproduce in microfilming.

Can a Tennessee notary, notarize in another state?

Not unless we are commissioned in that state however, if you have a document from another state as long as the notarial act occurs in the sate in which they were commissioned. Meaning if someone from Kentucky or Arkansas is visiting Tennessee, I can notarize it here during your visit.

What is Remote Online Notary (RON)

In April of 2018, the Tennessee Legislature passed Senate Bill 1758 known as the “Online Notary Public Act”. This Act went in effect as of July 1, 2019. The Act defines “Online Notarization” as “a notarial act performed by means of two-way video and audio conference technology…”.

This means that the notary and the principal whose signature is notarized are not in the same place but interact remotely over the internet. All regular notary rules apply to these transactions including the requirement for the notary to confirm the identity and state of mind of the principal, the voluntary nature of the act and the legality of the document. 

Online notarial acts performed in Tennessee will generally be honored by other states, including states that have not yet passed RON laws. Each individual state has it's own varying requirements, but established precedents have set forth that online notarial acts performed compliantly with the applicable state RON laws can be recognized as valid across state lines.

What types of Remote Online Notarizations (RON) are permitted in Tennessee?

Tennessee allows online notaries to perform the same notarial acts as traditional notaries including POA, bills of sale, tax returns, and many more.
